The author may publish his own portfolio by exercising the right of authorship over his own work, right guaranteed no matter what the performed cessions are. This happens not only because the author exercises his authorship rights ( reproduction, distribution, public performance) but also for exercising non-authorship ones (moral rights),strictly connected to his person as individual.
Moral rights are non-transferable ( 1st paragraph of Article 11of Labour Law No. 8 1996 ) this means that any convention through which the author cedes his non-authorship rights wil be considered null, no matter what. A right of this kind is also the right to call upon the quality of being the author of an work,also named the authorship right. Consequently it cannot even be supposed the transfer of this right to the cessionary of the authorship rights, since we are in imperative circumstances " moral rights cannot be surrendered or estranged."
The nature and the different identification of the moral rights are sustained through stipulations in the Berne Convention Article 6 bis „Independent of the author’s economic rights, and even after the transfer of the said rights, the author shall have the right to claim authorship of the work”.
